1. Introduction

Welcome to Pakashop. Pakashop ("the Platform") is a multi-vendor ecommerce platform designed to connect Vendors (merchants and businesses) with Buyers (consumers and businesses) across the Republic of Zambia.

By accessing or using the Platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Key Definitions:

  • Platform: The Pakashop website, mobile application, and related services.
  • Vendor: A registered business or individual selling products on Pakashop.
  • Buyer: Any individual or entity purchasing products from a Vendor on Pakashop.
  • User: Anyone accessing the Platform (Vendors, Buyers, and visitors).
  • Order: A finalized purchase agreement between a Buyer and a Vendor.

2. Eligibility

To use Pakashop, you must be at least 18 years of age. By registering, you represent that you have the legal capacity to enter into binding contracts. Vendors engaging in B2B transactions must provide a valid Taxpayer Identification Number (TPIN) as required by the Zambia Revenue Authority (ZRA). Pakashop reserves the right to verify identities and business registrations at any time.

3. Account Registration

Users must provide accurate, current, and complete information during registration. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Pakashop reserves the right to suspend or terminate accounts that provide false information or violate these Terms.

4. Vendor Terms (Sellers)

Vendors are responsible for the accuracy of their listings, including descriptions, pricing, and high-quality images. While Vendors retain ownership of their content, they grant Pakashop a non-exclusive license to display and promote such content.

  • Fulfillment: Vendors are solely responsible for order preparation, packaging, and shipping to the Buyer.
  • Tax Compliance: Vendors must comply with all ZRA regulations, including VAT and Smart Invoice requirements where applicable.
  • Commission: Pakashop charges a 10% commission on the total value of each sale. This fee is automatically deducted before payout.
  • Payouts: Vendor balances (after commission) will be paid out according to the platform's standard payout schedule, provided all delivery conditions are met.

5. Buyer Terms (Customers)

Buyers agree to provide valid shipping addresses and payment information. For B2B transactions, business customers must provide their company name and TPIN during checkout to receive compliant tax invoices.

Notice: Pakashop acts as a facilitator. Product quality guarantees and specific warranties are the responsibility of the Vendor. Disputes regarding product defects should be raised with the Vendor through our support system.

6. Payments and Fees

All payments are processed through our secure integrated gateway, Flutterwave. Pakashop supports local payment methods including mobile money (Airtel, MTN, Zamtel) and cards. Fees are clearly displayed at checkout. Refunds are subject to Vendor approval; while Pakashop will assist in dispute resolution, we do not guarantee third-party refunds.

7. Prohibited Activities

Users may not list or purchase:

  • • Narcotics or illegal drugs
  • • Counterfeit or stolen goods
  • • Weapons and hazardous materials
  • • Adult content or services

fraudulent activities, price manipulation, and platform scraping are strictly prohibited.

8. Intellectual Property

All software, design, branding, and logos are the exclusive property of Pakashop. Users may not reproduce or use Pakashop's intellectual property without express written permission.

9. Limitation of Liability

Pakashop is provided on an "as is" and "as available" basis. To the maximum extent permitted by Zambian law, Pakashop shall not be liable for indirect, incidental, or consequential damages arising from the use of the Platform or disputes between Users. Our total liability is limited to the fees paid by the User to the Platform in the preceding three (3) months.

10. Termination

You may close your account at any time by contacting support. Pakashop reserves the right to suspend or terminate access for violations of these Terms. Upon termination, any pending orders must still be fulfilled or appropriately refunded.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Zambia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Zambia.

12. Changes to Terms

We may update these Terms from time to time. We will notify Users of significant changes via email or a notice on the Platform. Continued use of Pakashop after such changes constitutes acceptance of the new Terms.
